Disputes are acknowledged within 72 business hours. Invalid provisions are severable.
Preamble
The following provisions are incorporated into the GÜÜR Services Agreement and each annex document by reference. They reflect mandatory provisions of Mongolian law that the parties cannot exclude, restrict, or modify by contract. In the event of any conflict between this Schedule A and any other provision of the Services Agreement or any annex, Schedule A prevails.
A.1 Mandatory Consumer-Law Backstop
Nothing in this Agreement excludes, restricts, or modifies any consumer right that under the Law of Mongolia on Consumer Protection (2011) or any other applicable mandatory provision of Mongolian law cannot be excluded, restricted, or modified.
To the extent any provision of this Agreement is inconsistent with such a mandatory provision, the mandatory provision shall prevail and the remainder of this Agreement shall continue in full force and effect.
A.2 Governing Language
This Agreement is executed in English. A Mongolian translation will be made available on the Platform. In the event of any inconsistency between the English and Mongolian versions:
- the Mongolian version shall prevail in matters concerning a user who is a consumer resident in Mongolia; and
- the English version shall prevail in all other cases.
Where any Mongolian regulator, court, or tax authority requires submission in Mongolian, the Mongolian translation shall be the version filed.
A.3 Electronic Signature
Your use of the Platform or Services constitutes your electronic signature and ongoing acceptance of this Agreement, as amended, in accordance with the Law of Mongolia on Electronic Signature and the Law of Mongolia on Electronic Transactions.
By creating an account, you agree that your click-through assent has the same legal effect as a handwritten signature for the purposes of the Civil Code of Mongolia.
A.4 e-Barimt Receipts
Where Mongolian law requires the issuance of an electronic VAT receipt (e-Barimt), GÜÜR will issue or facilitate the issuance of such receipts through the General Department of Taxation's e-Barimt system at https://e-barimt.mn.
Where the user is a host responsible for issuing an e-Barimt for rental income, GÜÜR will provide the transactional data necessary to enable the host to discharge that obligation. See also the VAT and e-Barimt section of the Fees Overview.
A.5 Capacity of Minors
For the purposes of this Agreement, a minor is any individual under the age of 18 years (the age of full legal capacity under Article 14 of the Civil Code of Mongolia).
Persons aged 14–17 may have limited contractual capacity in accordance with Articles 16–18 of the Civil Code. Bookings by such persons require the consent of a parent or legal guardian.
A.6 Limitation Periods
No notice period or contractual time-bar in this Agreement shall be construed to shorten any statutory limitation period available to a user who is a consumer under Articles 75–79 of the Civil Code of Mongolia or the Law of Mongolia on Consumer Protection (2011).
A.7 Dispute Response Service-Level
GÜÜR will acknowledge receipt of any dispute notice within 72 hours during business days:
| Business days | Monday – Friday |
|---|---|
| Business hours | 09:00 – 18:00 Ulaanbaatar time (UTC+8) |
| Exclusions | Mongolian public holidays |
| Out-of-hours receipt | Dispute notices received outside business hours are deemed received on the next business day. |
A.8 Severability
If any provision of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction or a competent Mongolian regulator — including the Agency for Fair Competition and Consumer Protection or the Communications Regulatory Commission — that provision shall be severed from this Agreement and the remaining provisions shall continue in full force and effect.
